Terms of Service

These Terms govern your use of TextByte. By using the service or signing up for updates, you agree to them.

What TextByte is

TextByte is a business messaging platform. You send and receive text messages with your customers from a real phone number we provision for you, in a shared team inbox, backed by a contact database. We handle carrier registration, number provisioning, and messaging compliance setup on your behalf. TextByte is for business-to-customer messaging, not personal use, and is available in the United States.

Text messages from TextByte

If you provide your mobile number and check the opt-in box, you agree to receive recurring text messages from TextByte, such as early-access and account updates.

  • Carriers are not liable for delayed or undelivered messages.

How we handle the information you provide is described in our Privacy Policy. Your mobile number is never shared with third parties or affiliates for their marketing.

You are the sender of record

When you send messages to your own customers through TextByte, you are the sender, and that carries real responsibilities:

  • Consent is yours to obtain. You are responsible for getting the consent required to message each recipient and for complying with applicable law and industry rules, including the TCPA and the CTIA Messaging Principles and Best Practices. TextByte gives you tools to honor opt-outs — automatic STOP, START, and HELP keyword handling and per-contact consent tracking — but we provide the opt-out mechanism, not your recipients’ consent.
  • Importing contacts is not consent. Adding contacts, including by CSV import, does not by itself establish that anyone agreed to be messaged.

Accurate business registration

To send business text messages, your business must be registered with the mobile carriers and industry registries that authorize business messaging. We collect the required information during onboarding — your legal business name, tax ID, address, and an authorized representative’s details — and submit it on your behalf to those carriers and registries. You are responsible for the accuracy of that information and confirm you are authorized to provide it. Inaccurate or incomplete information can delay approval or get your messaging blocked.

Acceptable use and prohibited content

You agree not to use TextByte to send messages in carrier-restricted or unlawful categories — for example, illegal or age-restricted goods, fraudulent or deceptive content, hate or harassment — and not to send unsolicited or misleading messages. You are responsible for the content you send and how you use the service. We may update the prohibited-use categories as carrier rules change.

Suspension and termination

We may suspend or limit sending — for your workspace or an individual number — to keep the platform compliant, to respond to carrier requirements, or to address a violation of these Terms. Sending is also gated by your registration status: until your carrier registration is active, and for any contact who has opted out, messages will not go out. You may stop using TextByte at any time.

Fees and message allowances

Carriers and messaging providers charge fees for things like registration, number provisioning, and message delivery, and those costs may be passed through to you. Where a plan shows a monthly message allowance, related usage and overage terms apply once billing is enabled. Higher-tier and enterprise access is arranged with our team.

No PHI or other regulated data

TextByte is not designed for protected health information (PHI) or other specially regulated data, and you agree not to send it through the service. We do not offer a Business Associate Agreement (BAA), and nothing here is a representation that TextByte is suitable for HIPAA-regulated use.

Availability and liability

TextByte is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties and are not liable for indirect, incidental, or consequential damages. Message delivery depends on the mobile carriers, and we cannot guarantee that every message will be delivered or delivered on time.

Your data

How we collect, use, and protect information is described in our Privacy Policy. In short: TextByte is US-hosted, each workspace’s data is isolated at the database level, and your messaging credentials are encrypted at rest with AES-256-GCM.
